Terms and conditions
English translation · German original
Here are the general terms for your stay. The services, prices and rate conditions that apply to your booking are set out in your booking offer and confirmation.
Choose a topic to open the details.
01Your booking
Your contracting party is Hotel Wittelsbach e.K., proprietor Marcus Eismann, Hauptstraße 48, 83324 Ruhpolding, registered with the Traunstein Local Court under HRA 2006.
These terms apply to the provision of hotel rooms and related services. They do not apply to package travel contracts.
Bookings may only be made by adults. By booking, you confirm that you are at least 18 years old.
The contract is formed when we accept your booking. For online bookings, the step that makes the booking binding is clearly marked. Individually agreed terms take precedence. Your own terms and conditions apply only if we have expressly agreed to them in text form.
You book a room category. A specific room is guaranteed only where expressly agreed. In exceptional cases, we may upgrade you to a higher room category at no extra charge. Any expressly agreed essential room features will be retained.
Subletting or use for purposes other than accommodation requires our prior consent in text form.
02Who is staying?
Everyone staying must be included in each booking. Please also state the ages of any children.
03Children
Children aged eight and over are welcome and may be included in your booking. In exceptional cases, younger children may stay by prior arrangement and with our express confirmation.
04Travelling with your dog
Dogs may stay on request and once we have confirmed this. The best time to ask is straight after booking, during Pre-Check-in in My Townhouse. The supplement is €20 per day. Other animals are not permitted. Statutory rights concerning assistance dogs remain unaffected.
05Prices and payment
The prices, services and payment conditions agreed when booking apply. This also applies to separate arrangements for group bookings. Taxes and additional charges are shown as specified in the booking offer.
Additional services are charged at the agreed prices. Advance payments and security deposits are due at the agreed times. Statutory provisions apply in the event of late payment.
Where objectively justified, for example by outstanding payments or additional services ordered, we may request a reasonable advance payment or security within the limits permitted by law. Payments already made will be taken into account.
Unless otherwise agreed, invoices are payable in full within ten days of receipt. Invoices may be sent electronically.
You may set off claims that are undisputed or established by a final court decision. Any further statutory rights of set-off remain unaffected.
06If your plans change
The rate conditions agreed when booking apply to cancellations, no-shows and early departures. You will find the applicable cancellation deadline in your booking. Statutory rights remain unaffected.
To cancel, please use the cancellation function provided with your booking or email info@twnhs.com. Timely receipt is what matters. If you booked through a portal, please preferably use its cancellation function.
07If we need to withdraw from the contract
Your booking is binding on us too. Withdrawal or termination is possible only in cases provided for by the contract or by law.
If we have agreed a free cancellation period and receive other enquiries for the booked rooms, we may ask you, allowing a reasonable time to reply, whether you waive your right to cancel free of charge. If you do not waive that right within the time allowed, we may also withdraw during the agreed cancellation period. The same applies to a booking option where other enquiries have been received and, after we contact you and allow a reasonable time to reply, you do not confirm a firm booking.
An objectively justified good cause may exist in particular where:
- force majeure or other circumstances beyond our responsibility make fulfilment of the contract impossible;
- you culpably provide materially false or misleading information or withhold material facts, particularly concerning identity, ability to pay or the purpose of the stay;
- there are reasonable grounds to believe that the stay may jeopardise the hotel’s smooth operation, safety or public reputation, without this being attributable to our sphere of control or organisation;
- the stay serves an unlawful purpose or the room is sublet without the required consent.
If agreed and due advance payments or security are not provided even after a reasonable additional deadline, we may withdraw from the contract subject to the statutory requirements.
We will inform you without undue delay. Refunds and further claims are governed by statutory provisions.
08Arrive smart. Leave at ease.
The Townhouse operates without a traditional reception desk. It is best to complete your Smart Check-in straight after booking. Your key and all information are in your personal guest area, My Townhouse.
Your room and key are available from 3pm on arrival day. Earlier arrival is possible only by express agreement. No smartphone? Please contact us beforehand so we can arrange a key card for you.
Please keep your access details secure and do not share them with unauthorised people. Tell us promptly about a lost key, suspected misuse or technical problems.
Check-out is by 10am. Where available, you can book and pay for late check-out online in My Townhouse. The times and prices shown there apply.
Remaining in the room beyond the agreed time without an agreement does not entitle you to extend your stay. Any claims are governed by statutory provisions.
09Sharing the house
Please look after your room and the shared areas. Furniture and furnishings should stay in their designated places.
Quiet hours are from 10.30pm to 7.30am. Please be considerate during the day too. Parties and events are not permitted without prior agreement.
You may bring your own food. Drinks brought from elsewhere are not permitted in the Lounge and Living areas. Breakfast is to be enjoyed on the premises; buffet food is not intended to be taken away. Please do not bring your luggage into the breakfast area.
Your booking and the relevant offers state which services, such as breakfast, cleaning or parking, are included or can be booked separately.
10A smoke-free stay
The entire Townhouse is smoke-free. Smoking is permitted outdoors only.
If you smoke indoors, we charge a flat fee for the additional cleaning required of €200. You are free to demonstrate that no loss, or a substantially lower loss, has occurred. We may claim a demonstrably higher loss, in which case the flat fee will be credited against it.
11Our house rules. For everyone’s comfort.
We are responsible for a safe and respectful stay. Please follow the house rules and our team’s legitimate instructions.
In the event of serious or repeated breaches, we may terminate the stay and require you to leave the premises, subject to the statutory requirements. This applies in particular to threats, discriminatory behaviour, harassment, endangering others or serious disruption of hotel operations.
Where required, a warning or request to stop the breach will be given first. In particularly serious cases, immediate termination may be justified.
12If something is not right
Please let us know about any defects or problems as promptly as possible so we can put things right. Please provide reasonable assistance in doing so. Your statutory rights remain unaffected.
You are liable under statutory provisions for damage you culpably cause. This may include proven consequential losses, for example where a damaged room cannot be let. Normal wear and tear is not damage.
13Our liability
Our liability is unlimited in cases of intent or gross negligence and for culpable injury to life, body or health.
For a slightly negligent breach of essential contractual obligations, our liability is limited to foreseeable loss typical of the contract. Essential obligations are those whose fulfilment makes performance of the contract possible and on whose observance you may ordinarily rely. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
These provisions also apply to our legal representatives and persons engaged in performing our obligations. Mandatory statutory liability provisions remain unaffected.
Statutory provisions apply to belongings brought into the hotel. Please expressly arrange any special safekeeping of valuables with us.
Providing a parking space does not create a safekeeping or security contract. Our statutory liability remains unaffected.
14Your data
You can find out how we process personal data in our Privacy notice. Please also read the privacy information on the premises.
15A few final formalities
It is best to record changes or additions in text form so everything remains clear. Individual agreements take precedence.
German law applies. Mandatory consumer protection provisions of your country of habitual residence remain unaffected.
For merchants, legal entities under public law and special funds under public law, Traunstein is the place of jurisdiction to the extent permitted by law. Otherwise, statutory rules on jurisdiction apply.
We do not participate in dispute resolution proceedings before a consumer arbitration body.
